Press Release November 11 2009 A San Diego County Superior Court Judge tentatively awarded $1,089,000.00 in compensatory damages to Operation Education, Inc. and $300,000.00 in punitive damages in its lawsuit against the Tactical Learning, LLC. a.k.a. Smart Industries, LLC in case no. 37-2007-00083585-CU-BC-CTL, after a 4 day contested bench trial. The Court in its tentative decision found willful misappropriation and conversion by Tactical aka Smart Industries of the intellectual property of Operation Education, Inc., a business selling College Level Examination Programs to military personnel. Operation Education, Inc. sued in 2008 for alleged violations by Tactical Learning, LLC a.k.a. Smart Industries LLC of the California Uniform Trade Secrets act by knowingly misappropriated trade secrets from Operation Education, Inc. through former consultants of Operation Education, Inc... The former employees of Operation education subsequently became principles of the start-up Cross-defendant Tactical Learning, LLC aka Smart Industries, LLC. A new important case for pleading Trade Secret violations cases in California came out. KC Multimedia v Bank of America held that the California Uniform Trade Secrets Act preempts many common law tort causes when they involve the same nucleus of fact. So beware when pleading that your common law claims involve some arguable difference or they will be preempted and subject to demurrer or summary adjudication. Defense counsel would do well to ferret out boilerplate pleading which incorporates by reference identical claims and fact and have them stricken under KC Multimedia reasoning.

Case 37-2009 -00074490 Tried March 16 2010 department S-4 the Goodman Law firm successfully prosecuted it's claim for money damages and defended claims of misrepresentation under 15 USC 1692, the Rosenthal Act and as against ancillary standing issues related to mesne assignments of the debt to plaintiff Cavalry Portfolio.
