A San Diego County Superior Court Judge tentatively awarded $1,089,000.00 in compensatory damages to Operation Education, Inc. and $300,000.00 in punitive damages in its lawsuit against the Tactical Learning, LLC. a.k.a. Smart Industries, LLC in case no. 37-2007-00083585-CU-BC-CTL, after a 4 day contested bench trial. The Court in its tentative decision found willful misappropriation and conversion by Tactical aka Smart Industries of the intellectual property of Operation Education, Inc., a business selling College Level Examination Programs to military personnel. Operation Education, Inc. sued in 2008 for alleged violations by Tactical Learning, LLC a.k.a. Smart Industries LLC of the California Uniform Trade Secrets act by knowingly misappropriated trade secrets from Operation Education, Inc. through former consultants of Operation Education, Inc... The former employees of Operation education subsequently became principles of the start-up Cross-defendant Tactical Learning, LLC aka Smart Industries, LLC.

DePUY Product Liability Litigation
Attorney Goodman takes on Depuy ASR Hip System Cases. Specifically, the cases involve both the ASR XL Acetabular System and the ASR Hip Resurfacing System. This is product liability litigation involving hip replacements wherein the devices fail at an unacceptable rate causing the need for revision surgery. The devices are the subject of a manufacturers recall in year 2010. Additionally, the devices can release metal ions into the blood of patients receiving the surgery with attendant damage. These separate suits filed in State Court in Los Angeles are pending Coordination Proceedings per Rule 1550(b) in San Francisco Superior Court.

Settlement
Attorney Goodman represented the defendant in civil action 37-2010-00085624 wherein plaintiff alleged fraud, negligent misrepresentation, breach of fiduciary duty, action for accounting and breach of contract arising from consignment auction of professional sports memorabilia. Damages claimed were $250,000 plus interest, punitive damages, attorneys fees and costs. The case settled the day before trial call for nuisance value amount in exchange for release and dismissal with prejudice.
